Clean Genies Terms of Service

Welcome to Clean Genies! These Terms of Service (“Terms”) govern your access to and use of the Clean Genies platform, including our website, subdomains (e.g., sarah.cleangenies.com), mobile tools, and third-party integrations (collectively, the “Platform”). By accessing or using the Platform, you agree to these Terms and our Privacy Policy.

1. Overview of Platform Role

Clean Genies is a marketplace intermediary that connects customers with independent cleaning professionals (“Providers”). Clean Genies does not perform cleaning services, does not employ Providers, and assumes no liability for services rendered.

2. User Eligibility

You must be at least 18 years old and legally able to enter into binding agreements to use the Platform.

3. Booking & Payment Terms

  • All bookings are made through our booking platform (powered by BookingKoala).
  • Payment is securely processed via Stripe Connect. Clean Genies collects a platform service fee included in your total price.
  • Providers receive payment directly through Stripe. Clean Genies never holds service funds beyond its fee portion.
  • Tipping is optional and paid directly to the Provider.

4. Independent Contractors

All Providers are independent contractors. They control their pricing, availability, service standards, and tools. Clean Genies does not:

  • Supervise or direct Providers’ work
  • Guarantee service outcomes
  • Provide equipment, insurance, or employment benefits

5. Cancellation & Refunds

  • Customers may cancel or reschedule a booking at least 24 hours in advance.
  • Cancellations within 24 hours may incur up to a 50 percent charge.
  • If a Provider fails to show, Clean Genies will offer to rebook or issue a refund at our discretion.

6. Trust Badges & Vetting

Clean Genies displays badges for Providers who have submitted verification (insurance, background checks, certifications, etc.). However, badge presence is not a warranty, and customers assume responsibility for selecting Providers based on visible credentials.

7. Liability Disclaimer

You acknowledge that:

  • Clean Genies is not the service provider.
  • Clean Genies is not liable for damage, theft, injury, dissatisfaction, or disputes arising from services booked through the Platform.
  • You agree to release Clean Genies from any claims arising from or related to services rendered by Providers.

Any disputes must first be addressed with the Provider. Clean Genies may offer support but is not obligated to intervene.

8. Dispute Resolution & Arbitration

All disputes will be resolved through binding arbitration in Wake County, North Carolina under the rules of the American Arbitration Association. You waive the right to a jury trial or class action.

9. Acceptable Use

You agree to:

  • Use the Platform lawfully
  • Not attempt to bypass the platform or contract directly with Providers outside of it
  • Not harass, abuse, or discriminate against any Providers or Clean Genies representatives

Clean Genies may suspend or terminate your account for violations.

10. Data Privacy

Clean Genies respects your privacy. We only share your data with:

  • Providers (for booking fulfillment)
  • Stripe (for payment processing)
  • BookingKoala (for scheduling)

11. Intellectual Property

All trademarks, branding, text, images, badges, and technology are owned by Clean Genies. You may not use them without prior written consent.

12. Modifications to Terms

Clean Genies may update these Terms periodically. Continued use after changes constitutes acceptance. We will notify you of major updates via email or website banners.

13. Severability

If any provision of these Terms is found to be unenforceable, the remaining sections shall remain in full force and effect.

15. Platform Access & Account Termination

Clean Genies reserves the right to:

  • Suspend or terminate your access at any time, with or without cause
  • Remove or delist Providers who fail to meet trust badge requirements, quality expectations, or breach conduct terms

16. Force Majeure Clause

Clean Genies is not liable for delays or failures caused by events outside our control, including:

  • Natural disasters
  • Internet outages
  • Government actions
  • Epidemics or pandemics

17. Non-Circumvention Clause

By using the Platform, customers agree not to hire Providers outside of Clean Genies for at least 12 months following their last booking.
Violating this may result in:

  • Account suspension
  • A fee equal to Clean Genies’ lost platform fees over that time

18. Provider Insurance Acknowledgement (for Customers)

You acknowledge that:

  • Not all Providers carry insurance
  • Badge display indicates submitted documentation but does not constitute Clean Genies’ insurance or coverage
  • You are encouraged to select Providers based on badge preferences

19. User-Generated Content

Any reviews, feedback, or content submitted through the Platform may be:

  • Publicly displayed
  • Used by Clean Genies for marketing or platform improvement
  • Removed at Clean Genies’ discretion for offensive, misleading, or false content

20. Governing Law

This Agreement shall be governed by the laws of North Carolina, without regard to conflict of law provisions. All disputes will be resolved in Wake County, unless otherwise resolved via arbitration.
